General
These Terms and Conditions form part of the agreement between the guest and Charm of the Algarve. Portuguese law applies to this rental agreement. By transferring the requested deposit the guest agrees with the conditions stated below.
Reservation
The guest can book one or multiple rooms via the internet, by email or by telephone. The reservation will be confirmed by Charm of the Algarve by e-mail. Upon receipt of the confirmation, the guest must transfer a deposit to the account of Charm of the Algarve within 14 days. After transferring the first payment, the reservation is completed and binding. The confirmation and these conditions together form the rental agreement. Minimum stay is 2 nights (3 nights in July and August).
Payment
The deposit is 50% of the total room price and must be paid to Charm of the Algarve within 14 days of the confirmation date unless otherwise stated. If the down payment period is exceeded, Charm of the Algarve reserves the right to consider the reservation to be dissolved and to release the accommodation for rental. The final term can be paid upon arrival.
Prices
The price is agreed on the basis of the rates applicable at the time, which are determined by Charm of the Algarve. If, after setting the price, due to a surcharge on the part of Charm of the Algarve, additional costs arise as a result of an increase of charges and / or levies directly related to the accommodation, these can be passed on to the guest, also after the conclusion of the agreement. All prices stated on the website are in euros and include the applicable B.T.W. rate. The prices are exclusive of tourist tax, other levies and / or taxes and other supplements (whether or not imposed by the government) unless explicitly stated otherwise.
Cancellation
Cancellation can only be done in writing. We advise our guests to take a cancellation insurance.
In case of cancellation the guest owes the following amounts.
- up to 46 days before arrival 50% of the deposit will be returned.
- 45-30 days before arrival the deposit will not be returned.
- 29 or less days before arrival the entire amount will be charged.
If Charm of the Algarve is forced by circumstances (including force majeure) to cancel the already rented, the guest will also be notified in writing. The amount already paid by the guest will be refunded. Guest has no more and no other right than the already paid amount.
Included in the room price
Prices of the rooms are in Euro and per room per night, including breakfast and VAT.
The room price includes normal use of electricity and water. Bed linen and household linen and regular cleaning costs are included. The rooms are regularly provided with clean towels and freshened up. We change the bedding once a week.
The guest declares to use the accommodation in a neat manner and to leave it in a tidy state on departure. Use of the kitchen is not possible. We will gladly advise you about delicious and inexpensive eateries and restaurants in the area.
Additional costs
If you fail to use the accommodation in a proper manner, an extra cleaning fee of € 50 will be charged. In case of exceptional use of electricity and / or water, an extra amount of € 10 per day will be charged. ‘Normal use of electricity and water’ means: use of equipment, taking into account the house rules in the room.
An extra person in the room is possible for a surcharge of € 35, – per night calculated per room. Availability of an extra bed must always be checked in advance and will be agreed upon on availability. We are an adults only guesthouse and welcome children from the age of 13 years.
Arrival and departure
On the day of arrival the accommodation can be used from 3 pm unless otherwise agreed. On the day of departure, the accommodation must be vacated by 11 am. Deviations from this rule can be discussed on a case-by-case basis. A later arrival or an earlier departure does not entitle the guest to a refund of the room price or part thereof.
Use and liability
The guest is not allowed to accommodate more people in the accommodation and / or to stay overnight than the number stated on the booking confirmation, unless expressly agreed otherwise with Charm of the Algarve. During the rental period, the guest takes care of the careful management of the rented room and is liable for any damage caused during the stay. Any damage caused by the actions or omissions of the guest will be settled, without prejudice to the guest’s obligation to pay full compensation.
Damages must be reported directly to Charm of the Algarve by the guest. Not reported damage will also be recovered from the guest.
Charm of the Algarve is not liable for defects in and the functioning of technical installations and equipment. Repair or replacement do not entitle the guest to a refund of (a part of) the room price. Charm of the Algarve will ensure that repairs or replacement are carried out as quickly as possible.
Smoking is not allowed. If there is smoking inside, € 200, – cleaning costs will be charged to the guest.
Charm of the Algarve can not be held liable for personal injury or damage, theft or loss of property of the guest. Charm of the Algarve is also not liable for any damage that the guest and / or his travel companions suffer due to any cause related to the accommodation. Charm of the Algarve will not be liable for compensation for any damage.
The property does not accept liability for:
- theft, loss or damage, of whatever nature, during or as a result of a stay at Charm of the Algarve.
- disabling or decommissioning of technical equipment and the failure or closure of facilities at Charm of the Algarve. This also applies to the consequences of external weather influences or other forms of force majeure. Unless there is gross negligence or intent on the part of Charm of the Algarve.
The guest and the person accompanying him or her are jointly and severally liable for all loss and / or damage that will arise for the property and / or any third party as a direct or indirect consequence of their stay, regardless of whether this was caused by acts or omissions on their part. or third parties who are at their disposal in Charm of the Algarve as well as any damage caused by any animal and / or property they have in their possession.
Bringing pets is not permitted unless otherwise agreed with Charm of the Algarve.
Charm of the Algarve undertakes, after notification of the guest of inconvenience reported by other guests, appropriate measures.
Swimming
Children under the age of 12 are not allowed to use the pool without an adult. Parents and / or supervisors must ensure that children wear swimming-pads or swim-jackets when they can not swim.
Change or supplement to the agreement
If the guest wishes to make further changes to the agreement after the conclusion of the agreement, Charm of the Algarve is free to determine whether and to what extent changes will be accepted. For this, change costs can be charged of € 10 per change. These change costs will not be charged in case of a booking, extension or change to a more expensive period or more expensive room. In case of a change to a cheaper period or cheaper room, the original total price remains due. An addition to an already made agreement is, in so far as it does not also include a change, in principle possible, of course with due observance of these general conditions. No additional costs are associated with the addition of this supplement to Charm of the Algarve. Extension of the length of stay is in principle possible on the basis of availability.
Charm of the Algarve is entitled at any time to reject a request for an extension. Changes and additions can be notified in the same way as can be reserved. If Charm of the Algarve is unable to fully or partially comply with the agreement due to force majeure, Charm of the Algarve will submit a change proposal to the guest. This amendment proposal may be rejected by the guest.
